1. The information and material provided on this website is provided free of charge (except where otherwise stated) and solely for illustrative purposes. It is not intended to and does not establish a business, contractual or employment relationship with Cenarth Adventure Centre.

The information, contents, text, images, including but not limited to html code, scripts, and photography is the property of Cenarth Adventure Centre otherwise acknowledged) and may not be copied, reproduced, republished, posted, transmitted, or distributed in any way without our express, advance, written consent.

This site is provided "as is" and Cenarth Adventure Centre expressly disclaims all warranties of any kind whether express or implied including the warranties of merchantability and fitness for a particular purpose. In no event shall Cenarth Adventure Centre or any of its employees or contractors be liable for any damages whatsoever in connection with the information or material on this website, including but not limited to actual, consequential, direct, exemplary, incidental, indirect, punitive or special damages.

No judgement or warranty is made with respect to such other services or sites and Cenarth Adventure Centre takes no responsibility for such other sites or services. PRICING AND VAT

All prices stated are in UK pounds Sterling and include VAT. All error and omissions accepted. Prices displayed include shipping to the UK Mainland only. Please email for international shipping costs. Prices are subject to change at any time.

Please note that all customers purchasing paintball markers must be over 18 years of age.

PAYMENT AND OWNERSHIP OF GOODS

Goods remain our property until paid for in full. If your issuing bank declines your debit or credit card payment, either before or after the despatch of goods, we will treat the order as cancelled. If the goods have been despatched we may require you to return the goods to us within 7 days or require you to pay in full by satisfactory means within 7 days.

In the event that any amounts become due (missing or damaged returned goods, credit or debit card charge backs) we reserve the right to engage the services of a debt recovery agent. Charges incurred as a result of this action will be your responsibility.

DELIVERY OF GOODS

Delivery within the UK is by Parcelforce or Royal Mail. We aim to deliver all orders within 5-7 working days (this does not include the day the order was placed or weekends) this is an aim but not a guarentee and does not form any contract between Cenarth Paintball Games Ltd and the customer.

Delivery is charged at £7 for all orders. If you are in a hurry for your order and would need it by a certain date, please contact us via email or phone 01559 371621 to check on the possibilty and cost of an express delivery.

All orders must be delivered to the registered cardholder’s address, address checks will take place, so to avoid unnecessary delay please ensure the correct address is given.

If we cannot fulfil or deliver your order within these times or have any other problems with your order, we will contact you by email as soon as possible. We will also give you an expected delivery date and allow you to cancel your order if you wish.

Order Cancellation

If any of the items you order are not in stock, delivery may take up to 28 days. You have the right to cancel your order as long as it has not been shipped. To cancel your order or to check the status of your order please call us on 01559 371621.

Liability

Our delivery liability is reflected in the terms and conditions that Royal Mail and Parcelforce afford us and is limited to postage refund only.

Please Note: CPG cannot be held responsible for any delays caused by Acts of God, industrial action, vehicle breakdown, service providers, credit searches, stock availability and delivery companies.

Damaged in Transit

If you suspect your product to have been damaged in transit please contact us on 01559 371621 so that we can arrange a replacement. Please make a note on the drivers delivery note that the packaging was “damaged” upon arrival before signing for it.

RETURNS AND EXCHANGES

Non-Faulty Goods.

Under the Distance Selling Directive, you have the right to return your goods for a full refund as long as you notify us within 7 working days from the day after you receive the goods. Used markers are non-refundable, unless it is found to be faulty. You will need to call us on 01559 371621 for an authorisation number for a return.

You, the consumer, are obliged to take reasonable care of the items and return them in unused condition with the original packaging and accompanied by the original receipt. The consumer is obliged to return the goods at their own cost within 14 days; CPG will not refund this cost. The consumer is responsible for the goods until they are back in the possession of CPG, the consumer must claim for any damages caused on the return, from the courier used. If the goods are not returned in unused condition then the right to full refund is forfeited.

Please remember that you are not legally entitled to a refund, subject to Distance Selling Regulations, if:

• You have changed your mind about the goods.
• You have damaged the goods.
• You find that you no longer need the goods.

We recommend the use of Royal Mail Special Delivery to return products to us. This provides an insured method of carriage with tracking and destination receipt signature. No responsibility or refund can be made for items lost or stolen whilst in transit to us. All returns are usually processed within 72 hours of receipt. We will only accept returned products that have been authorized for return by our technicians – please phone 01559 371621 to attain a return number (RET) before posting the goods. Also, when Returning your product please include full details of the fault and full contact details.

Errors

Order Errors (yours) In the unlikely event that you have ordered items you did not want, and have not been in touch before they are picked and dispatched, returns may be subject to a 20% restocking fee

Picking Errors (Ours) In the unlikely event that the goods you have received do not reflect your order, please accept our immediate apologies and allow us to correct the situation. Please contact us on 01559 371621 so that we can arrange for the correct products to be sent to you.

Picking Errors (Manufacturer) If you suspect that your pre-packaged goods have missing or incorrect items please contact us on 01559 371621.

Warranty Repair

All items sold are accompanied with the respective manufacturers warranty only.

If you suspect your product to be faulty within its warranty period you must contact us by telephone, prior to sending the articles back and obtain instructions and authorised returns reference (RET return number) from the sales staff. You will be responsible for the postage costs both ways for any returns or warranty repairs.

We will give refunds in accordance with your legal rights under the Sale of Goods Act 1979 i.e. where goods are not of satisfactory quality or as described. Due to the nature of the products we sell, CPG does not offer refunds on markers or air/co2 systems.

We shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow manufactures instructions, misuse, or alteration or repair of the goods (other than that done by our staff).

CO2 & Air bottles

Co2 or Air bottles, as used for containing marker propellants, will be delivered non-filled. Most UK sites will NOT fill CO2 and air bottles for players, so please make sure you have explored how you are going to fill the bottle prior to purchase. CO2 and air bottles should be filled by a qualified person.

PAINT DISCLAIMER:

Important, Please read before buying.
All paintballs as shipped by courier. Paintballs are sent intact and checked. After paintballs leave the shop we are no longer in control of the way they are treated. We do not accept returns under any circumstances. This includes paintballs degrading due to cold conditions or paintballs broken in transit and found damaged upon delivery.

Use of Paintballs

Paintballs should not be used on public land. These paintballs are sold to be used at recognised paintball centres where the owners of those centres allow the use of own paintballs. Currently only certain walk on and tournament events allow the use of your own paintballs. There are currently NO sites in the UK who allow you to take your own paintballs to a recreational day. If you are in doubt, please call the site you are playing at directly to check their policy. If you are caught using your own paintballs at a paintball centre that does not allow the use of your own paintballs, it is likely that you will be ejected from that site without refund. Taking paintballs to a recreational day is like taking your own beer to a pub. You can drink it at home, but if you want the atmosphere of a pub you go to a pub. This is a common sense warning!!

HANDLING COMPLAINTS

We will handle any complaint in a fair, effective and confidential manner. We not only endeavour to respond to any complaint within five working days but also to have it fully resolved.

WEBSITE ACCURACY

Our Software Developers and Product Managers work extremely hard to ensure our website is as accurate as possible, however we cannot guarantee and be held responsible for any claim resulting from the accuracy of the information supplied. Pictures of products are for illustration only. Product specifications may change without prior notice.

TELEPHONE ORDERING

We aim to give the most accurate and up to date information available when taking telephone orders, however we cannot guarantee and be held responsible for any claim resulting from the accuracy of the information supplied. Product specifications may change without prior notice.
We may record all telephone conversations for confirmation and training purposes.

GOVERNING LAW AND CONTRACT INFORMATION

No contract will exist between you and CPG for the sale of any product unless and until your order has been shipped and until then the right is reserved to decline your order. These contracts do not affect the consumers' statutory rights.

These terms and conditions shall be governed by and construed in accordance with the laws of England and the parties irrevocably submit to the exclusive jurisdiction of the English Courts.

If any part of our terms and conditions is determined by a UK court to be invalid, illegal, void or otherwise unenforceable under any current or future law, the remainder of our terms and conditions shall not be affected thereby.

DISCLAIMER

To the fullest extent permitted by law, CPG is providing its web sites and contents on an "as is" basis and makes no (and expressly disclaims all) representations or warranties of any kind with respect to its web sites or its contents including, without limitation, warranties of merchantability and fitness for a particular purpose. Except as specifically stated on its web sites, to the fullest extent permitted by law, neither CPG nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with the use of its' web sites.
